This is the Privacy Policy for Local Advantage (referred to as Local Advantage, us, we, or our). This Privacy Policy sets out Local Advantage’s practices in line with the Australian Privacy Principles under the Privacy Act 1988 (Cth) and, where applicable, the General Data Protection Regulation (GDPR – Regulation (EU) 2016/679).
A reference to ‘Personal Information’ in this policy refers to both ‘Personal Information’ as defined in the Privacy Act and to ‘Personal Data’ for the purposes of the GDPR (if it applies to you).
This Privacy Policy describes the types of Personal Information we collect, why we collect it, and what you can do if you would like to remove yourself from our mailing list, correct details we hold about you, or exercise any other rights available to you.

2. What Personal Information Do We Collect?

When redeeming an offer or making a booking
Name, email address, telephone number, IP address, and the name of the vendor you are redeeming an offer with. We may also record how many times you have visited a vendor, your personal consumer preferences, and on some occasions your spend and the items you are purchasing.
When contacting us, applying for employment, or dealing with us as a supplier or customer
Depending on the nature of the contact, we may collect names, addresses, telephone numbers, email addresses, and IP addresses. For employment applicants and employees, we may also collect tax file numbers and other information required for employment purposes.
When using our website
We collect your IP address and our servers will attempt to place session cookies on your device so that the website functions effectively. These cookies are not persistent and are not used to identify you after the relevant web session.
We use cookies to operate and improve your experience on our site, including allowing you to sign in faster, keeping you signed in, and tracking how the site is used. If you do not allow cookies, some or all parts of the website may not be accessible to you.
When using our mobile application — Location Data
Our mobile application may request access to your device’s location. We collect and use location data for the following purposes:
- To display and filter offers relevant to your current location, helping you find savings at businesses near you.
- To send push notifications about offers available from businesses in your vicinity, where you have enabled notifications.
The type of location access we use is as follows:
- Foreground location (while the app is in use): used to filter and display nearby offers in real time.
- Background location (when the app is not actively in use): used only where necessary to deliver proximity-based push notifications, and only where you have granted this permission on your device.
Location access is always subject to the permissions you grant on your device. You can withdraw location permissions at any time through your device settings. Doing so will not affect your ability to browse and redeem offers manually through the app — it will only limit location-based features such as proximity filtering and nearby notifications.
We do not sell your location data to third parties. Location data is used solely for the purposes described in this policy and is not used to build advertising profiles or for any commercial purpose beyond improving your in-app experience.
3. Collection Statement
Local Advantage (ABN 71 966 705 234) and its related entities, collect, hold, use, and disclose the personal information you provide in accordance with this Privacy Policy, so that we can enable the vendors you engage with to communicate with you and provide offers and invitations. We may also use your information to improve our platform.
We may disclose your personal information to third-party service providers who assist us in delivering our services, such as technology service providers. Some of these providers have servers located in the US, UK, and Australia.

Vendors
Participating vendors will also collect personal information about you when you make a purchase or otherwise deal with them. Those collection and use practices are the responsibility of the individual vendors or business groups, not Local Advantage.
4. How Do We Collect and Store Your Personal Information?
We collect Personal Information in a number of ways, including:
- information submitted through our website or mobile application;
- web analytics;
- communications with you, including emails and phone calls;
- information supplied to us by third parties; and
- location data collected automatically through the app when you grant location permissions on your device.
We hold Personal Information in:
- systems used in connection with our business, some of which may be owned and operated by our suppliers;
- our hard copy files; and
- databases associated with our website and application.
Where it is lawful and practical to do so, we will give you the option of not identifying yourself or not providing Personal Information. However, if you choose not to provide certain information, we may be unable to supply the products, services, or support you are seeking.
We will retain your Personal Information for as long as needed or permitted in light of the purpose(s) for which it was obtained. Factors we consider include:
- the length of time we have a relationship with you or a vendor;

When your Personal Information is no longer required, it is destroyed in a secure manner.
5. What Do We Use Your Personal Information For?
We collect, hold, use, and disclose Personal Information for the following purposes:
- supplying you with our services, including vendor offer redemption and gift vouchers;
- sending subscription and service-related emails;
- sending SMS messages for customer service and marketing purposes;
- improving the website and app experience for our members;
- recording spend and visitation history to help vendors personalise your experience; and
- using location data to display nearby offers and deliver proximity-based push notifications, where location permissions have been granted on your device.
We also use Personal Information for internal business purposes, including:
- data analysis to improve our products and services;
- auditing internal processes to ensure regulatory compliance;
- fraud detection and security monitoring;
- developing new products and services;
- identifying usage trends to understand which services are of most interest to our members;

We do not share your location data with vendors, advertisers, or any third parties for commercial purposes. Location data is used solely within the Local Advantage platform to provide location-based features as described in this policy.
7. Data Storage and Overseas Processing
We may store your information with third-party services in the ordinary course of our business. This includes circumstances where:
- our website or hosting services are operated by a third party whose facilities or disaster recovery sites are located overseas. In some cases it is not practicable for us to advise you of the specific countries where your Personal Information may be held or processed;
- third-party applications used in connection with our services (such as email, help desk, or VoIP providers) are hosted overseas, and we have no direct control over where those providers store data; or
- Personal Information is sent outside Australia for processing — in these cases we will enter into formal contracts with those processors containing privacy terms that allow us to meet our obligations to you.
8. Use of Social Media
Our website includes links to social media platforms including Facebook, Instagram, and similar services. These platforms actively enable the exchange and disclosure of any information included within them. Any Personal Information you share through those platforms is subject to the privacy policies of those services. We have no control over how that information is used, stored, or disclosed.
9. Your Rights Regarding Your Personal Information
You have the right to access the Personal Information we hold about you and to request that it be corrected or erased. If you believe information we hold is inaccurate, out of date, incomplete, or irrelevant, please contact us and we will either provide you with access or correct it within a reasonable period. We may charge a reasonable fee for access, but we will not charge for making the request itself or for making a correction.
In certain circumstances, you may request that we restrict processing of your data while we investigate a complaint or to support a complaint to the Australian Information Commissioner.
Where your personal data is processed by automated means solely on the basis of your consent, you have the right to obtain and reuse that data in an electronic format for your own purposes across different services.
You have the right to object to our processing of your personal data in certain circumstances under the GDPR. ‘Processing’ includes collection, sharing, storage, retention, and destruction of your data.
You may unsubscribe from direct marketing at any time by selecting the ‘unsubscribe’ link in any email. Automated emails relating to payment and subscription renewal will cease if your Local Advantage account is deleted or auto-renewal is disabled in your account settings.
Your rights regarding location data
You may withdraw location permissions from the Local Advantage app at any time through your device settings. Withdrawing permissions will:
- stop the app from accessing your current location for offer filtering;
- stop proximity-based push notifications triggered by your location; and
- not affect your ability to browse the full offer catalogue or redeem offers manually.
You may also contact us to request access to, or deletion of, any location data held in association with your account.
10. Complaints
If you wish to make a complaint about a breach of any Australian Privacy Principle, a registered privacy code, the GDPR, or this Privacy Policy, please contact us using the details in Section 11 below.
We will use our best efforts to respond to any complaint within 5 business days of receipt and will work to resolve it to your satisfaction. If you are not satisfied with our response, you may contact the Australian Information Commissioner at www.oaic.gov.au.
